daytalens is a Customer Acquisition Intelligence Platform that uses Artificial Intelligence (AI) to help small business owners, coaches, and entrepreneurs identify why their marketing isn't generating sales. The platform provides diagnostic analysis, ideal customer profile (ICP) intelligence, and strategic playbooks to help you find and sell to your real buyers. The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

2. Free Trial and Payment Terms

Free Diagnostic:

• New users can complete a free 7-question acquisition diagnostic to receive a teaser result
• No credit card is required to run the initial diagnostic
• Access to the full Customer Playbook and ongoing intelligence requires a paid subscription

Subscription Plans:

• Subscription pricing is displayed at checkout and is subject to change with notice
• Subscriptions are billed monthly and grant full access to all platform features
• You may cancel your subscription at any time from your account settings
• All payments are processed securely through our payment provider

3. AI-Powered Analysis Disclaimer

daytalens uses advanced AI and Large Language Models (LLMs) to analyze your business data and generate diagnostic insights. You acknowledge and agree that:

• AI-generated diagnostic results, scores, and recommendations may contain errors or inaccuracies
• Insights are based on patterns from comparable businesses and may not perfectly reflect your unique situation
• You are solely responsible for evaluating and acting on any recommendations provided
• daytalens does not guarantee specific business outcomes, revenue increases, or sales results
• You assume all risks associated with business decisions made based on platform insights

4. Usage License and Intellectual Property

Your Data License to Us: By using daytalens, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, store, and process your diagnostic inputs and business profile data to generate insights
• Analyze anonymized, aggregated data to improve our pattern-matching models and service
• Develop new diagnostic features and capabilities

Ownership:

• You retain ownership of the business information you provide to daytalens
• Your generated playbooks and diagnostic reports are yours to use
• daytalens platform, code, AI models, and pattern databases remain our property

5. Prohibited Uses

You agree NOT to use daytalens to:

• Submit false or misleading business information to manipulate diagnostic results
• Resell, redistribute, or sublicense platform insights or reports without written consent
• Violate any third-party rights (copyright, trademark, privacy, etc.)
• Attempt to reverse-engineer, hack, or exploit the service or its underlying models
• Share your account credentials with others
• Use the service for any unlawful purpose

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, fraudulent activity, or any other reason at our sole discretion. You may delete your account at any time through profile settings.

• Business decisions made based on diagnostic results or recommendations

Any disputes arising from these Terms or your use of daytalens shall be resolved through:

• Arbitration: If unresolved, disputes shall be settled by binding arbitration
• No Class Actions: You agree to resolve disputes individually, not as a class action

We may update these Terms at any time. Significant changes will be communicated via email or in-app notification. Your continued use of daytalens after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which daytalens operates, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
