By accessing or using daytalens, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

1. Service Description

daytalens is a social media content generation platform that uses Artificial Intelligence (AI) to help small businesses create engaging posts. The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

2. Free Trial and Payment Terms

14-Day Free Trial:

• New users receive a 14-day free trial with full access to daytalens
• No credit card is required to start your trial
• At the end of the trial, you may choose to subscribe to continue using the service

Early Access Subscription ($29/month):

• The first 50 users get discounted early access pricing at $29/month
• Your subscription rate is locked-in at $29/month, even when regular pricing increases to $49/month
• Subscription is billed monthly and grants you full access to all features
• You may cancel your subscription at any time from your account settings
• All payments are processed securely through our payment provider

3. AI-Generated Content Disclaimer

daytalens uses advanced AI and Large Language Models (LLMs) to generate content. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or "hallucinations"
• Content may occasionally be inappropriate, offensive, or factually incorrect
• You are solely responsible for reviewing, editing, and verifying all content before publishing
• daytalens is NOT liable for any consequences of publishing AI-generated content
• You assume all risks associated with using and publishing AI-generated content

4. Usage License and Intellectual Property

Your Content License to Us: By using daytalens, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, store, and process your inputs to generate content
• Analyze anonymized usage data to improve our AI models and service
• Develop new features and capabilities

Ownership:

• You retain ownership of content you input into daytalens
• Generated content is yours to use as you see fit
• daytalens platform, code, and AI models remain our property

5. Prohibited Uses

You agree NOT to use daytalens to:

• Generate illegal, harmful, or fraudulent content
• Create spam, misinformation, or deceptive content
• Violate any third-party rights (copyright, trademark, privacy, etc.)
• Attempt to reverse-engineer, hack, or exploit the service
• Share your account credentials with others
• Use the service for any unlawful purpose

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, fraudulent activity, or any other reason at our sole discretion. You may delete your account at any time through profile settings.

• Any harm caused by content you publish using daytalens

Any disputes arising from these Terms or your use of daytalens shall be resolved through:

• Arbitration: If unresolved, disputes shall be settled by binding arbitration
• No Class Actions: You agree to resolve disputes individually, not as a class action

We may update these Terms at any time. Significant changes will be communicated via email or in-app notification. Your continued use of daytalens after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which daytalens operates, without regard to conflict of law principles.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
